Job Description

Responsible for assisting attorneys with day to day management of construction defect, automobile, general liability, employment and uninsured litigation including related additional insured and statutory right to repair claims.  Works closely with business locations to gather information and documents needed to respond to litigation and claims.  Handles tenders to carriers, brokers, third party administrators and indemnitors.  Maintains electronic claim files.  Responsible for entry of self-insured construction defect claims into risk management information system as well as creating and running reports for legal, accounting and actuary purposes.  Assists in responding to subpoenas and other special projects and administrative tasks as requested.   

 

Major Responsibilities:

Construction Defect Litigation & Claims:

  • Receives new claim information and creates or updates electronic files; notifies business location, assures compliance with Legal Hold Policy; and secures any necessary extension to respond to pleadings.
  • Obtains and reviews documents from claimant’s counsel and/or business location to determine if claim is discharged due to bankruptcy and responds accordingly.
  • Tenders claims to applicable carrier(s), brokers, third party administrators and indemnitors; confirms business unit’s scope of work, identifies homes where materials and or services were provided and applicable dates; obtains job files and other company records for production to defense counsel.
  • Provides monthly reports to in house attorneys as requested on status of construction defect suits and claims; provides statistics to corporate office for tracking litigation and claim volume and processes invoices for payment.
  • Assists TPA/adjusters on additional insured tenders, providing information on scope of work, homes where materials and or services were provided and applicable dates, type of indemnity obligation and AI status granted.
  • Consolidates all open construction defect insurance claims onto third party risk management information system, updates payment and reserve information, creates and runs reports as requested from RMIS system and legacy carrier systems.


Automobile, General Liability, Employment and Uninsured Litigation:

  • Receives new claim information and creates or updates electronic files; notifies business location, assures compliance with Legal Hold Policy; and secures any necessary extension to respond to pleadings.
  • Tenders claims to applicable carrier(s), brokers, third party administrators and indemnitors; obtains underlying documents and information required to assist in house attorneys and assigned defense counsel.
  • Creates and runs reports as requested from RMIS system and legacy carrier systems.
  • Processes invoices for payment on uninsured claims.

Subpoenas, Record Retention, Special Projects:

  • Assists in responding to subpoenas as requested.
  • Ensures compliance with Record Retention Policy for all in house claim files
  • Drafts documents and assists in house attorneys in triaging various legal issues.

 

Others duties as assigned.
   



Required Skills
  • Bachelor Degree with Paralegal Certification from ABA accredited institution.
  • Ability to read, analyze and interpret legal documents, government regulations, insurance documents, financial reports and professional and technical journals.
  • Ability to define problems, collect data, establish facts, and draw valid conclusions.  Ability to effectively present information to peers, supervisors, business locations and legal vendors.
  • Strong verbal and written communication skills.
  • Highly organized with the ability to prioritize and manage multiple tasks.
  • Strong time management skills.
  • Ability to maintain confidentiality.
  • Advanced computer skills including Power Point and Excel.


Required Experience
  • Minimum 8-10 years of experience in litigation defense (in house experience a plus).
  • Experience with data entry and report writing on litigation management and/or risk management information systems.
